1. About Us

The myTovi platform is operated by TOVI STUDIO SRL, a company registered in Romania under Trade Register No. J2025080837009, with fiscal code (CUI) RO52751450, having its registered office at București, Sectorul 2, Bulevardul Ferdinand I, Nr. 118, Etaj 5, Ap. 509, Romania.

2. What myTovi Does

myTovi is a product lifecycle and anti-theft platform. Using digital security tags embedded in physical products, myTovi enables:

  • Product authenticity verification via NFC scan
  • Digital ownership registration and transfer
  • Anti-theft monitoring through ToviGuard™
  • Product care information and lifecycle tracking

3. Account Creation

To use myTovi's ownership features, you must create an account by providing your email address and verifying it via a one-time code (OTP). By creating an account, you confirm that:

  • You are at least 16 years of age (per GDPR Art. 8 and Romanian Law 190/2018)
  • The email address you provide is accurate and belongs to you
  • You agree to these Terms and our Privacy Policy

4. Product Ownership & Claiming

When you scan a Tovi-tagged product and enter the correct claim PIN, myTovi registers you as the digital owner. This digital ownership record:

  • Confirms you possess the physical product with its unique digital security tag
  • Enables you to transfer ownership, activate ToviGuard™, and access product information
  • Does not constitute proof of legal ownership or title — it is a digital registration

5. ToviGuard™ (Anti-Theft)

ToviGuard™ allows you to report a product as missing. When activated:

  • The product's NFC/RFID signature is added to the monitoring set at partner locations
  • If the product is detected at a partner store's RFID gate, you will be notified by email
  • Anonymous sighting reports from the public may also trigger notifications
  • ToviGuard™ alerts expire after 90 days and can be renewed

ToviGuard™ is a monitoring tool — it does not guarantee recovery of missing products. TOVI STUDIO SRL is not liable for product loss, theft, or failure to detect.

6. Ownership Transfer

You may transfer digital ownership of a product to another person via email invitation. Transfers require email confirmation from both parties and expire after 24 hours. ToviGuard™ must be deactivated before initiating a transfer.

7. Account Deletion

You may delete your account at any time from the Account settings page. Upon deletion:

  • All owned products are released (ownership cleared)
  • Active ToviGuard™ alerts are deactivated
  • Pending transfers are cancelled
  • Detection events linked to your products are purged
  • Your authentication credentials are permanently deleted

8. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to claim products you do not physically possess
  • Submit false sighting reports
  • Interfere with or disrupt the platform's operation
  • Attempt to access other users' accounts or data

9. Limitation of Liability

To the maximum extent permitted by Romanian law, TOVI STUDIO SRL shall not be liable for:

  • Loss or theft of physical products
  • Failure of NFC/RFID hardware or detection systems
  • Service interruptions or unavailability
  • Indirect, consequential, or incidental damages

Nothing in these terms excludes liability that cannot be excluded under Romanian or EU law, including liability for death or personal injury caused by negligence, or for fraud.

10. Right of Withdrawal

Under OUG 34/2014 (transposing EU Directive 2011/83/EU), you have the right to withdraw from this contract within 14 calendar days of account creation without giving any reason.

To exercise this right, contact us at hello@mytovi.com with an unambiguous statement of withdrawal, or simply delete your account from the Account settings page.

If you have already used the service (e.g., claimed a product), you acknowledge that the service has been fully performed and the withdrawal right no longer applies to the extent of services already rendered.

11. Intellectual Property

The Tovi and myTovi names, logos, and platform software are the property of TOVI STUDIO SRL. You may not reproduce, distribute, or create derivative works without written permission.

12. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via email or in-app notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

13. Governing Law & Disputes

These terms are governed by the laws of Romania. Disputes will be resolved by the competent courts of Bucharest, Romania.

You may also file a complaint with ANPC (Autoritatea Națională pentru Protecția Consumatorilor) at anpc.ro, or use alternative dispute resolution (SAL) — see anpc.ro/ce-este-sal.

14. Digital Services Act

Tovi operates as a hosting service under EU Regulation 2022/2065 (Digital Services Act). We do not host publicly disseminated user-generated content. We moderate fraudulent claim activity and impersonation.
